The following Terms of Services applies to the www.polygon.games web site ("Web Site") and to the software, services, products, resources, information, content and materials which we use during the Services

The Web Site is provided by Mixort Sp. z O.O. (Collectively referred to in this agreement as “Polygon.Games” or “Supplier”). By using the Site, registering for a course, and/or affirmatively giving your agreement, you are agreeing on your own behalf to abide and be bound by the Privacy Policy and the Terms of Services contained and referenced herein.

Your use of certain resources made available on the Web Site or the conduct of certain transactions may be subject to certain additional terms and conditions, which will be made available to you prior to using such resources or conducting such transactions. Polygon.Games reserves the right to modify, alter, update, or remove portions of this Terms at any time, so please check this Terms from time to time.

Your continued use of the Web Site signifies your acceptance of any changed items. If you do not agree with Terms of Service, your sole remedy is to discontinue your use of the Web Site. The failure of the Polygon.Games to enforce, in whole or in part, this Terms, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

Description of the Services

The Services include delivering online-courses and facilitating supporting materials. At Polygon.Games we provide online courses for game creators. These Courses are primarily aimed at game design. If you are purchasing, or participating in, an online Course, you agree on your own behalf and on behalf of your enrollee to the following.

You are solely responsible for all service, telephony, data charges and/or other fees and costs associated with your access to and use of the Services, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use.

If You elect to access or use our Services that involve payment of a fee, then you agree to pay, and will be responsible for payment of, that fee and all taxes associated with such access or use. If you provide credit card information to pay for such fees then you hereby represent and warrant that you are authorized to supply such information and hereby authorize to charge your credit card to pay the fees as they are due.

All of your use, access and other activities relating to the Services must be in compliance with all applicable laws and regulations, including, without limitations, laws relating to copyright and other intellectual property use, and to privacy and personal identity. Further, access to our Services from territories where their contents are illegal is prohibited. You must agree to abide by all local rules regarding online conduct and acceptable content.

About the Course

We do not guarantee the availability of or space in any course. Only enrollees who are registered and paid for the Course may participate – you agree that you will not allow more than one enrollee to use an account at a time to simultaneously participate in a course without separate registrations and payments. Courses, unless specifically noted in the Course description, are only taught in English.

We may video record each Course session. These recordings are taken solely for purposes of improving the product, and we do not provide copies of these recordings to anybody in order to protect the privacy of all the enrollees. While the Courses are generally open to all learners, we reserve the right to refuse enrollment for any enrollee for any reason, including but not limited to, past disruptive behaviour or nonpayment of Course fees.

Customer data

You need a Discord account for most course activities on our platform, including to access content or to submit content for supervising. You must provide and continue to provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.

You may not share your account login credentials with anyone else. You are responsible for what happens with your account and Polygon.Games will not intervene in disputes between students or instructors who have shared account login credentials. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting our Support Team. We may request some information from you to confirm that you are indeed the owner of your account.

While participating in the Polygon.Games community, you may submit to our resources, links, applets, information, content, software code, graphics, artwork, templates or other materials ("Submissions"). You hereby grant to Polygon.Games a non-exclusive, perpetual, worldwide, royalty-free license to link to, reproduce, distribute, adapt, perform, display and create derivative works from your Submissions, and to sublicense any of the foregoing rights. If your Submissions include software source code, the foregoing license includes the right to analyze, report on, summarize and display the source code.

Students and instructors must be at least 18 years of age to create an account and use the Services. If you are younger than 18 but above the required age for consent to use online services where you live (for example, 13 in the US or 16 in Ireland), you may not set up an account, but we encourage you to invite a parent or guardian to open an account and help you access content that is appropriate for you. If you are below this age of consent to use online services, you may not create an account. If we discover that you have created an account that violates these rules, we will terminate your account.

Payment and Fees

Payment to participate in any of our Courses is due at the time of sign-up and is non-transferable or refundable except in our discretion. Please contact us if you have any payment problems or you wish to make changes to your Course enrollment.

For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for details.

In the event we offer a promotional discount, such discounts are limited to one discount per Enrollee. There may be other limitations as to how they apply, and codes must be submitted at the time of registration. Polygon.Games will not honor retroactive adjustments, and the total discounts received cannot exceed the total cost of the products purchased.

You agree to pay the fees for Course that you purchase, and you authorize us to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. Polygon.Games works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using information provided by our payment service providers. Check out our Privacy Policy for more details.

When you make a purchase, you agree not to use an invalid or unauthorized payment method. We reserve the right to disable access to any content for which we have not received adequate payment.

Once an item has been purchased, students may request a refund up to 30 days from the date of purchase assuming they have not accessed any areas of the Polygon.Games resources that include educational materials. This includes course resources areas, all Polygon.Games channels, and/or other areas of the Discord where downloadable files are available.

In no event will Course fees be refunded after the start of the Course. No refunds, credits, or classes will be provided if a lesson is missed.

Code of Conduct

To promote the best learning environment possible, all enrollees will be held to this Code of Conduct. Failure to comply with this Code of Conduct or engaging in actions or attitudes that seem to be harmful to the atmosphere, other participants, or staff, in the opinion of Polygon.Games or its instructors can lead to removal from a Course or Course(s).

Refunds will not be given for enrollees dismissed for failure of the Enrollee to abide by the Code of Conduct. While Polygon.Games strives to maintain excellent relationships with enrollees, in some rare cases, we may determine that Polygon.Games is not a compatible environment for every enrollee.

Enrollees may never:

Disrupt, bully, intimidate, or harass others;

Use inappropriate language (for example, enrollees cannot use of swear or curse words, racial, gendered, homophobic/transphobic, stereotypical, or culturally insensitive words, even if done in a joking manner);

 View, display or post any inappropriate material (including sexual content, material depicting inappropriate violence, racism, bullying, etc.) during a Course;

Share Course information (including lesson plans, Game Plan access etc.) with third-parties, without permission from Polygon.Games;

Impersonate another person;

Share or create video or audio recordings of Polygon.Games Courses or another enrollee without the permission of Polygon.Games.

Termination

Upon termination of your use of the Services for any reason, all of your rights to access and use of the Services shall immediately terminate.

Following termination or expiration of a course program, we will have no obligation to maintain or provide any data and may thereafter, unless legally prohibited, delete all data in our systems or otherwise in our possession or under our control.

Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflicts of laws principles. You expressly agree that the exclusive jurisdiction for any claim or dispute under these Terms of Service and your use of the Services resides in the courts of the Republic of Poland and you agree also to submit to the personal jurisdiction of these courts for the purposes of litigating any such claim or action.

Warranty Disclaimer

The Services are provided “AS IS”, “WITH ALL FAULTS”, and “AS AVAILABLE”. YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. WE do not GUARANTEE that users will be able to access the Services at all times or places, that we will have adequate capacity for all users, OR THAT THE SERVICES WILL BE OPERABLE with your equipment. TO THE FULLEST EXTENT PERMITTED BY LAW, WE, OUR OFFICERS AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, including implied warranties of merchantability, suitability, quality, accuracy, fitness for particular purposes and non-infringement. WE MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE CONTENT OF ANY WEB SITES LINKED TO THE SERVICES.

Limitation of Liability

IN NO EVENT SHALL WE, OUR OFFICERS OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY

ERRORS, MISTAKES, OR INACCURACIES OF THE SERVICES CONTENT,

PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR USE OF THE SERVICES,

ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN,

ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES OR INTEROPERABILITY PROBLEMS,

ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY,

ANY ERRORS OR OMISSIONS IN ANY CONTENT,

USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY,

YOUR USE, OR INABILITY TO USE, ANY PORTION OF THE SERVICES OR FOR ANY LOSS OR DAMAGE OF ANY KIND (INCLUDING YOUR DATA) INCURRED AS A RESULT OF YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
